The Presidium of the National People's Congress, also known as the Presidium of the United Commonwealth or simply the Presidium, is the permanent standing body of the National People's Congress (NPC), the highest ranking legislative body of the United Commonwealth. Although formally subservient and accountable in all its actions to the National People's Congress, the Presidium is most often the de facto leading body of legislative power in the country, responsible for drafting laws and decrees, which are voted upon and approved when the Congress is in session. The Presidium is de jure regarded as the collective head of state for the United Commonwealth, and is formally a council of equal members, although in practice the chairperson of the council, known as the President of the United Commonwealth, oversees the direction of the council and acts in the capacity of head of state. The President is supported by a second leading official, known as the Vice President, as well as deputy secretaries. There are currently five members of the Presidium of the 28th National People's Congress, although historically the composition of the Presidium has varied from three to eight members. Currently every member of the Presidium is also a member of the Continentalist Party of the United Commonwealth and its highest ranking body, the 37th Secretariat.

The Presidium is elected by a joint session of the Congress of the Union and the House of the Republics within the National People's Congress, following each regular national legislative election, making election to the Presidium a four year term. Although the Constitution of the United Commonwealth since 1982 has dictated limitations on the office of President, general members of the Presidium are not subject to any term limit, although in practice since 1982 there has been an informal agreement not to serve more than four terms. The Presidium is empowered with similar abilities and powers to the National People's Congress, with some notable limitations, such as the inability to formally ratify a declaration of war. Otherwise, the Presidium has the full capability to enact legislation, dictate edicts to local and regional bodies, form state committees, and appoint state officials. The Presidium has the right to veto legislative proposals by the Congress, however the Congress may override this veto by a two-third majority. The Congress also has the power to impeach members of the Presidium by vote. The structure of the Presidium is also mirrored in the legislative structures of the continental republics and most autonomous regions, with these regional presidiums acting virtually identically to their national counterpart. The national Presidium also has the ability to directly delegate to regional presidiums for the enactment or enforcement of legislation.

Constitutional powers

According to the 1982 Constitution of the United Commonwealth, the Presidium is entrusted to do the following:

  • Draft and propose legislation, except those to be enacted only by the full assembly of the National People's Congress
  • Pass legislation or supplemental amendments to legislation when the NPC is not in session, to be approved by the NPC
  • Veto legislation of the NPC from being enacted, except if this veto is overrode by a two-thirds majority of the NPC
  • Interpret currently existing Continental laws
  • Promulgate Continental decrees and initiate national referenda
  • Abrogate previous decrees, including those issued by the Council of People's Commissars in the case that there is discrepancy with the law
  • Recommend a Premier to be confirmed by the NPC
  • Ratify changes to the composition of the People's Commissars at the recommendation of the Premier
  • Form and disband ministries and state committees based on proposals from the People's Commissars
  • Ratify or abrogate treaties and important agreements reached with foreign countries
  • Represent the NPC in its relations with parliaments of foreign countries
  • Appoint or dismiss plenipotentiaries to foreign countries
  • Receive letters of credence and letters of recall from foreign diplomatic representatives
  • Declare martial law in the country or in a given region, in the interest of defending the country or preserving public order and security
  • Supervise the enforcement of the Constitution, reserving the right to annul administrative regulations, decisions, and orders of the People's Commissars, republic governments, and local governments that contravene the Constitution, Continental laws, or administrative regulations
  • Examine and approve partial adjustments to national economic and social development plans and their respective budgets
  • Establish orders and medals of the United Commonwealth and implement awarding procedures
  • Establish honorary titles and oversee their assignment
  • Establish military, diplomatic, and special ranks
